BIG is 100% correct.  The courts will decide that, as well as the case's
ultimate outcome.  Discussion of this issue is a matter for the court,
not the FML.  It is a not a matter involving public opinion and heresay,
but rather a private legal matter.  That said, my response:
 
With the ongoing campaign to discredit and portray me as "persona non
grata" within the ferret community---I will once again try to respond to
Sue Thomas' most recent accusations and questions in regard to GIGGLES and
CRICKET.  Let it first be known that I have not "threatened BIG with a
lawsuit" nor asked him not to let Sue Thomas or Jackie Hawley post.  That
was BIG's decision to "close the thread." Previously, when I wrote BIG on
the evening when I was being "cyber-stalked" by "persons unknown" (at the
time) I emailed BIG to learn what "....you believe your legal
responsibilities are in this regard"....and asked him to further "provide
me with whatever information is necessary in regard to CUNY's involvement
in the FML" in order to learn the identity of said "person(s) unknown".
As I also felt compelled to report the very real (and documented) threat
to me/my property to my local law enforcement office---which has been
done----and wanted BIG to be aware of same.  If someone is stating
otherwise to try to further discredit me; well then they don't have copies
of my and/or BIG's respective responses.  BIG chose not to help and instead
stated he would "ignore all communications from me without a court order".
Thus, I unsubscribed and bothered BIG no more as I continued to
pursue/document these harassing calls/emails/vandalizations of my property
etc.  through other means.  With BIG permitting a second post from Sue now;
I can only believe BIG now wishes to let FMLers to know "the other side"
of this particular incident--which happened in 1998.  BIG also made the
decision to close down the BEN&JEREMY thread without letting the other
side be told publicly.  That's cool (maybe not fair IMO) but BIG has that
prerogative as Moderator.
 
The Court is in possession of all the evidence in that case.  Facts.
Documented Facts.  Not just someone's "opinion" or "perception".  I'm
confident Truth will prevail in that case as well.  (BTW...An attorney is
NOT needed for a simple Replevins Small Claims case.  That venue was
specifically chosen by me so as to permit the Defendant the opportunity
to state her case at **no cost to her**.)
 
Here's the post I wrote back in December--but minus the part of my answer
BIG felt was "inappropriate".  The facts remain the same to this day.
 
SUE WROTE: "I am the person that found the Arcadia Ferrets and talked the
breeder into giving them up.  I brought 8 of them home with me & he
cancelled the remainder at auction until we contacted him." Yes, Sue, you
are indeed the person who first informed me of the Arcadia breeder after
you bought the eight breeders at auction....and you provided me with his
name and phone number.  You did indeed talk the breeder into the eight
ferrets you ended up with.  However it was the combined efforts of
several FL shelters and countless OTHER individuals that the rescue was
accomplished.  You admitted you had neither time; finances nor physical
resources to handle 58 unsocialized breeders and YOU called ME to do the
rest of the rescuing since both Angela(of the main SFFC&R) and I (as
Branch shelter) had experience with similar major rescues .
 
SUE WROTE: "I also gave Barbara 2 ferrets, Giggles and Cricket because she
said she had a home for them.  She took them to Jackie, Jackie kept them
for at least a year.  A few months ago, Barbara took them back from Jackie
also with one of them being very sick." Yes, there are elements of truth in
what you say.  I did originally get GIGGLES and CRICKET from you in
3/98....as they were included with the 13 ferrets you sent up to me to have
Dr. Kemmerer treat and/or needing surgeries.  (BTW Have you ever paid Dr.
Kemmerer for all those surgeries from 1998?)
 
FYI.... I'm now relating info copied directly from the completed OPERATION
SAFE Intake Forms; and handwritten exam notes by Dr. K upon initial
examination of these ferrets that had been in your care since November of
1997: GIGGLES was about 2 years of age already in full-blown "heat"; and
CRICKET just starting to show a slightly swollen vulva--CRICKET also over
3 years of age; had a suspicious lump under her left eye; and her teeth
were in terrible condition.
 
You claimed to be overwhelmed physically and financially so I offered to
find homes for as many as you would leave with me (and/or Dr. K) to place.
You left GIGGLES and CRICKET (as you said they were a bonded pair NOT to
be separated) and SWEETIE (who was immediately adopted by one of my
volunteers, Deb Mathewson).  Jackie Hawley was living up in Hinesville,
GA at the time---and she and I had begun corresponding via email and she
volunteered to place a pair.  Shortly thereafter I met Jackie halfway
between Hinesville GA and Jacksonville FL to deliver the girls to her.
They both needed more recovery time from their surgeries etc. and Jackie
does find personal fulfillment in providing same.
 
But as happens at Jackie's....the girls became more and more a part of
Jackie's life and never were adopted out.  Sadly, CRICKET started having
additional problems about a year later and in Feb. 1999 (per a report FROM
the Veterinary Diagnostic and Investigational Lab; College of Veterinary
Medicine; Univ.  of GA TO Richard Bink, DVM of Savannah, GA--who was
Jackie's vet---provided biopsy results of CRICKET's liver tissue.  Bottom
line from said Pathology report: "(The histology of) these changes are
most consistent w/chronic lymphohistlocytic periocholangitis."
 
At @ the same time (again about a year after Jackie accepted them), GIGGLES
also ran into problems with an abcess on her chin and over the course of a
month Dr. Bink also removed a growth; and provided treatment.  Was it not
now natural to assume Jackie decided to keep the girls--was bonded to
them--and basically with both their now obvious medical problems....were
Unadoptable now anyway--except to an experienced individual able and
willing to provide the continued veterinary care they would need?
 
In late March 2000 GIGGLES and CRICKET were returned to me by Jackie.  I
did not "take them".  Since our dispute in regard to BEN and JEREMY was
already ongoing for two months; Jackie decided she wanted "no more ties" to
me and with barely 24 hours notice returned eight ferrets to me (through a
willing third party who was friends with/volunteer for BOTH our shelters).
Five adoptables who Jackie was "fostering" and/or trying to find homes for
were returned; as were a bonded threesome (CASSIE; GIGGLES & CRICKET).
Jackie said ALL THREE FERRETS were over-due for annual exams/vaccinations
and CRICKET was always so lethargic....so I immediately scheduled appts.
with Dr. K.  CRICKET's CBC showed her WBC at 30,000!  Dr. K started her on
an antibiotic regimen with a re-check in 10 days.  Follow-up CBC showed
CRICKET's WBC was now at a normal 8,000 and she was back again being a
lively; playful ferret.
 
Half-truths only tell half the story, Sue.  The above are not just my
*opinion* but provable, documented facts.  Can you say the same?
