Definitely call animal control.  I don't know about the laws in your area,
but here in Miami it's against the law to not provide shelter from the
elements.
 
My neighbor had a dog that was relegated to their backyard, which had
absolutely no shade or anything that would allow the dog to escape the
rain or sun.  I used to look out and see the poor thing standing, leaning
against the house to escape the rain.  That didn't help much since the
house has about a 1 foot overhang.  I called animal control and they said
that not providing a place for shelter from the elements was illegal and
they came out and gave them a warning.  My neighbors never talk to us
anymore, but I don't care.
