We've experienced the bathtub-is-a-poddy syndrome as well.  Our way of
dealing with their 'protest' was to wake one from a nap, watch him/her
poddy (preferably IN the litter box), and then give them a nice warm bath.
This works with all our ferts except Buddy (adopted) who's basically a
constipated camel; he goes when he wants to, where he wants to, if he
wants to.  I guess you've got to give the elderly a little slack...:)
