Not entirely accurate. The USDA APHIS, after formal complaints that
McKay was selling more than $500 annually to other breeders (as posted
by a member of the McKay family on the FML!), did an inspection on July
30, 2007, and shut him down pending obtaining the necessary license.
This undoubtably led to McKay filing the lawsuit less than a month
later, and becoming more serious in negotiations with Lori Sies.
I have a copy of the inspection report obtained under the Freedom of
Information Act. It doesn't say much, just that he was found to be in
violation of the regulations.
